Release of Liability, Waiver of Claims, and Assumption of Risks

BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION.

I accept the terms of this Release of Liability, Waiver of Claims, and Assumption of Risks (the "Release and Waiver") by purchasing and taking part in ZROCK FITNESS INC.

ACCEPTANCE OF RISKS. I am aware of the risks, dangers, and hazards associated with the fitness program, including but not limited to the risk of death, serious injury, and accidental or incidental property damage. I acknowledge that my participation in the fitness program is voluntary (s). I voluntarily accept and fully accept all risks, dangers, and hazards associated with participating in the fitness activities in the class, including the possibility of injury, death, or property damage or incidental thereto, whether caused by the company's negligence or other consequences suffered by participant or any other person arising or resulting directly or indirectly from participant's participation in the class. In the event of an injury, the participant agrees to be financially responsible for all medical costs, damages, or injuries incurred as a result of using any facilities or services related to the activity, whether through personal health insurance or another route.

RULES. In addition to the terms and conditions stated here, I also agree to abide by all company rules, regulations, guidelines, and policies (collectively, the "Rules"), including but not limited to the terms and conditions stated on the company website (winnipegzumba.com), and I agree to hold the company harmless for any costs or losses incurred as a result of my failure to comply with the Rules, regardless of whether they were communicated to me orally or in writing. I understand that the Company may modify the Rules at any time and that I will be subject to any such modifications.

RISK OF FACILITY. I am aware that visiting the institution can entail using stairs, parking lots, and other areas that are unknown to me. I thus acknowledge that there is a chance that I could trip, slip, or fall before, during, or after the fitness program. I hereby waive any claim for damages against the Company (ZROCK FITNESS), its employees, or any hosting facility.

INDEMNIFICATION. In connection with any third-party claim, suit, action, or proceeding arising out of or related to the Fitness Program, I agree to defend, indemnify, and hold harmless the company and all other releases from any and all losses, damages, liabilities, deficiencies, claims, actions, judgements, settlements, interest, awards, penalties, fines, costs, or expenses of any kind, including reasonable legal fees.

ILLEGAL ACTIVITY. I acknowledge that the Company reserves the right to immediately cancel my participation in the Fitness Program if the Company discovers or suspects that I am engaging in any illegal activity, disorderly behavior, or physical or verbal abuse. I acknowledge that I am responsible for paying the total balance of the Fitness Program upon ceasing my participation. I understand that the Company will be free of all obligations upon termination thanks to this Release and Waiver.

DAMAGE. I am aware that any harm to the facility's property caused by me or my conduct will be my responsibility to repair.

SEVERABILITY. The invalidity, illegality, or unenforceability of any term or provision of this Release and Waiver shall not impact the validity or enforceability of any other term or provision of this Release and Waiver or render such term or provision unlawful or unenforceable in any other jurisdiction.

WAIVER OF CLAIMS AND RELEASE OF LIABILITY. I hereby expressly waive and release any claims I may have now or in the future against the Company, its directors, officers, partners, employees, contractors, agents, volunteers, shareholders, representatives, insurers, local operators, and all of their respective heirs, executors, administrators, successors, assigns, and personal representatives (collectively, "Releases") due to harm, illness, or death, including, but not limited to, the Company's or any other Release's negligence, a breach of contract, or a failure to uphold any legal or other duty of care mandated by occupiers responsibility legislation or otherwise. I promise not to file or pursue any claim of this nature against the Company or any other Release, and I forever absolve and dismiss the Company and any other Releases from all responsibility for such claims.

BINDING ON HEIRS AND SUCCESSORS. This Release and Waiver binds the Company and each of its respective successors and assigns, as well as me, my heirs, and next of kin. Furthermore, the participant acknowledges that he or she, as well as any spouses, heirs, guardians, or other legal representatives, will not hold ZROCK FITNESS liable for any losses or damages sustained as a consequence of the participant's participation in the activity.

GOVERNING LAWS. The laws of the Province of Manitoba and the applicable Canadian federal legislation shall govern this Release and Waiver and be followed in its interpretation. I hereby consent to the exclusive jurisdiction of the courts located in the Province of Manitoba to hear any claim or cause of action arising under this Release and Waiver.

By checking this option, I also consent to being photographed, videotaped, and/or recorded during the fitness program. ZROCK FITNESS may use and edit the photos and/or recordings for any purpose, including but not limited to marketing and advertising, without my permission or payment in the future.
